Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TCodeStudio ("Company," "we," "us," or "our") governing your access to and use of the 3DGS Viewer service, including our website, applications, and other software (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.

2. Eligibility

To use the Service, you must be at least 13 years of age. By using the Service, you represent and warrant that:

  • You are at least 13 years old
  • You have not been previously suspended or removed from the Service
  • Your registration and use of the Service complies with all applicable laws
  • You have the legal capacity to enter into a binding agreement

3. Account Registration

To access certain features of the Service, you may need to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept all risks of unauthorized access to your account
  • Notify us immediately if you discover any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

3DGS Viewer is a cloud-based platform that enables users to view, convert, store, and share 3D Gaussian Splatting files. The Service includes:

  • Browser-based 3D model visualization
  • Support for multiple file formats (PLY, SPZ, SPLAT, KSPLAT, SOG)
  • File conversion capabilities
  • Cloud storage for uploaded models
  • Shareable links for model viewing
  • View statistics and analytics for shared models

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

5.1 Prohibited Content

You may not upload, store, share, or transmit content that:

  • Is illegal, harmful, obscene, pornographic, or sexually explicit
  • Depicts or promotes violence, gore, or graphic content
  • Promotes discrimination, hate speech, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party
  • Contains malware, viruses, or any other harmful code
  • Violates any applicable local, state, national, or international law
  • Contains personal information of others without their consent
  • Impersonates any person or entity or misrepresents your affiliation
  • Encourages or provides instructions for illegal activities

5.2 Prohibited Conduct

You may not:

  • Use the Service to distribute spam, scams, or deceptive content
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Share your account credentials with third parties
  • Use the Service to compete with or replicate our offerings
  • Engage in any conduct that could damage our reputation

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including its original content, features, functionality, software, design, and all related intellectual property, is owned by TCodeStudio and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use our trademarks without our prior written consent.

6.2 Your Content

You retain all ownership rights to the 3D models and other content you upload to the Service ("User Content"). By uploading User Content, you grant TCodeStudio a worldwide, non-exclusive, royalty-free license to store, display, process, and transmit your User Content solely for the purpose of providing the Service to you.

6.3 Content Representations

You represent and warrant that: (a) you own or have the necessary rights to upload and share your User Content; (b) your User Content does not infringe any third party's intellectual property rights; (c) you have obtained all necessary consents from individuals whose data may be contained in your User Content.

7. Content Moderation

We reserve the right, but have no obligation, to monitor, review, and remove any User Content that violates these Terms or that we determine, in our sole discretion, to be objectionable or harmful. We may:

  • Remove or disable access to any content that violates these Terms
  • Terminate accounts of users who repeatedly violate our policies
  • Report illegal content to appropriate authorities
  • Implement automated systems to detect prohibited content

8. Subscription and Payments

8.1 Subscription Plans

We offer both free and paid subscription plans. Each plan has different features, storage limits, and capabilities as described on our pricing page. Paid subscriptions are billed on a recurring basis (monthly or annually) in advance.

8.2 Payment Terms

By subscribing to a paid plan, you authorize us to charge your chosen payment method for the subscription fees. You agree to provide accurate and complete billing information and to keep it current.

8.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, your access to paid features will continue until the end of your current billing period. All subscription fees are non-refundable except as required by applicable law or as explicitly stated in these Terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TCODESTUDIO DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; (C) THE QUALITY OF ANY PRODUCTS, SERVICES, OR INFORMATION PURCHASED OR OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

WE ARE NOT RESPONSIBLE FOR ANY CONTENT POSTED BY USERS OR ANY ACTIONS TAKEN BY USERS ON OR OFF THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TCODESTUDIO, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any content obtained from the Service
  • Any conduct or content of any third party on the Service

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless TCodeStudio and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) any content you submit or transmit through the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including: (a) breach of these Terms; (b) conduct that we determine to be harmful to other users, us, or third parties; (c) extended periods of inactivity; or (d) any other reason at our sole discretion.

Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete your account and all associated data; (c) no refunds will be provided for any unused portion of your subscription. You may terminate your account at any time by contacting us or through your account settings.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TCodeStudio is established, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

15. General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TCodeStudio regarding the Service and supersede all prior agreements and understandings.
